Terms and Conditions
1. Scope
These Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person, or a partnership with legal capacity, acting in the exercise of their commercial or independent professional activity when concluding a legal transaction.
2. Contract Partner, Conclusion of Contract, and Correction Options
The purchase contract is concluded with Madame Moda.
By placing products in the online shop, we make a binding offer to conclude a contract for these products. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process.
The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive a confirmation email.
3. Contract Language and Storage of Contract Text
The language available for the conclusion of the contract is:

4. Delivery Conditions
4.1 Delivery Area
We deliver within Germany.
4.2 Shipping Costs
In addition to the stated product prices, a standard shipping fee of €4.99 will be charged.
4.3 Delivery Options
Products are delivered to the delivery address specified during the ordering process.
We deliver by shipping only. Unfortunately, collection in person is not available.
We do not deliver to parcel lockers (Packstations).
5. Payment
The following payment methods are generally available in our shop:
Credit Card
You enter your credit card details during the ordering process. Your card will be charged immediately after the order has been placed.
Amazon Pay
To pay via Amazon Payments Europe S.C.A., 38 Avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate yourself using your login credentials, and confirm the payment instruction.
The payment transaction is processed by Amazon Pay within one banking business day after the order has been placed.
Amazon Pay may offer additional payment options to selected customers. We have no influence over the availability of these options.
Apple Pay
To pay via Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the Safari browser, be registered with Apple, have Apple Pay activated, authenticate yourself, and confirm the payment instruction.
The payment transaction is processed immediately after the order has been placed.
Google Pay
To pay via Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have Google Pay activated, authenticate yourself, and confirm the payment instruction.
The payment transaction is processed immediately after the order has been placed.
Klarna
In cooperation with Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer the following payment options.
Unless otherwise stated, payment via Klarna requires a successful address and credit check and is made directly to Klarna.
Invoice Payment via Klarna
The invoice amount is due within 14 days after shipment of the goods and receipt of the invoice.
Payment by invoice is available only to consumers.
Credit Card via Klarna
You provide your credit card details during the ordering process. Klarna charges your card immediately after the order is placed. No address or credit check is carried out.
Instant Payment via Klarna
To use Klarna’s instant payment service, you must have a Klarna account and an online banking-enabled bank account, authenticate yourself, and confirm the payment instruction.
No credit check is performed. Your account will be debited immediately after the order is placed.
PayPal and PayPal Express
To pay via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your login credentials, and confirm the payment instruction.
The payment transaction is processed immediately after the order has been placed.
PayPal may offer additional payment methods to selected customers. We have no influence over the availability of such options.
6. Retention of Title
The product remains our property until full payment has been received.
7. Transport Damage
If goods are delivered with obvious transport damage, please report such defects to the carrier immediately and contact us without delay.
Failure to submit a complaint or contact us does not affect your statutory rights, particularly your warranty rights. However, it helps us to assert our own claims against the carrier or transport insurer.
8. Warranty and Guarantees
8.1 Statutory Warranty Rights
The statutory warranty rights shall apply.
8.2 Guarantees and Customer Service
Information regarding any additional guarantees and their exact conditions can be found with the relevant product and on dedicated information pages within the online shop.
9. Liability
We shall be liable without limitation for claims arising from damages caused by us, our legal representatives, or our agents:

in the event of injury to life, body, or health;

in cases of intentional or gross negligence;

where a guarantee has been expressly agreed;

where liability arises under applicable product liability laws.
In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), whose fulfillment is necessary for the proper execution of the contract and on whose compliance the contractual partner may regularly rely, liability shall be limited to the foreseeable damage typical for the contract at the time the contract was concluded.
Otherwise, claims for damages are excluded.
10. Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
