General terms and conditions of business

1. Scope of Application

These Terms and Conditions (T&Cs) apply to all orders placed through our online store. Our online store is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person, or a legal partnership, acting in the exercise of their commercial or independent professional activity when entering into a legal transaction.

1. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Madame Moda.

By listing products in our online store, we make a binding offer to conclude a contract for these products. You may initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process.

The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive a confirmation by email.

1. Contract Language and Storage of Contract Text

The language available for the conclusion of the contract is:

We store the contract text on our systems; however, it is not directly accessible to you.

1. Delivery Conditions

4.1 Delivery Area

We deliver within Germany.

4.2 Shipping Costs

In addition to the stated product prices, standard shipping costs of €7.00 apply.

4.3 Delivery Options

Products will be shipped to the delivery address specified during the ordering process.

Delivery is made exclusively by shipping. Unfortunately, personal collection is not possible.

We do not deliver to parcel stations (Packstations).

1. Payment

The following payment methods are generally available in our online store:

Credit Card, Debit Card

During the ordering process, you enter your credit or debit card details. Your card will be charged immediately after the order has been placed.

The product remains our property until full payment has been received.

Information regarding any additional guarantees and their exact terms can be found with the respective product and on specific information pages within the online store.

1. Liability

We shall be liable without limitation for claims arising from damages caused by us, our legal representatives, or agents in the event of:

• Injury to life, body, or health

• Intentional or grossly negligent breach of duty

• Guarantee commitments, where agreed

• Liability under the German Product Liability Act (Produkthaftungsgesetz)

In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), whose fulfillment is necessary for the proper execution of the contract and on whose compliance the contractual partner may regularly rely, liability shall be limited to the foreseeable damage typical for the contract at the time of conclusion of the contract.

Otherwise, claims for damages are excluded.

1. Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform, which can be accessed online.

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
